Please read this policy carefully to understand our policies and practices regarding your information and how we will use and disclose your information that you make available to us. By accessing the Website or using the Services, you agree to this Privacy Policy; if you do not agree with our policies and practices, your choice is not to use the Services. Our Terms of Use is incorporated herein by reference, and capitalized terms used herein have the meaning set forth in the Terms of Use. We reserve the right to change this Privacy Policy at any time. Such changes shall be effective immediately upon notice thereof, which may be given by posting a notification on this site or by other means if required by law. It is your responsibility to review this Privacy Policy periodically. Your continued use of the site after such modifications constitutes your acknowledgment of the modified Privacy Policy.
1. The information we collect
We may collect certain information from you or about you, including: (A) information that identifies, relates to, describes, or could reasonably be linked to a particular person or household, such as your name, email address, date of birth, and address (“Personal Information”); and (B) information regarding how the Services are accessed and used by you, including access times, browser type and version, pages visited, time and date of visit, unique device identifiers, IP host address, operating system, device type, and similar data (“Usage Data”).
2. Collection of information
Usage Data is collected for every user of the Website and Services, whether or not you have an Account. Personal Information is collected when you submit it, including when you create an Account. We collect information directly from you, automatically as you navigate the Website and Services, and from certain third parties we have engaged to perform services for us.
3. Cookie information
“Cookies” are pieces of information placed on your computer to facilitate and enhance your interaction with a service. We may use cookies (and similar items such as web beacons and tags) to customize your visit and enhance our Services, including cookies from third-party service providers such as analytics providers. You may restrict or flush cookies through your browser preferences; doing so may interfere with some functionality.
4. How we use your information
We use your information to operate the Website and products, perform or fulfill Services you request, deliver information about our Services, improve and tailor services, inform you of changes, resolve disputes, troubleshoot problems, respond to inquiries, enforce our agreements, and perform analytics (including through Google Analytics; you may opt out at tools.google.com/dlpage/gaoptout). We may use your information for other specific purposes communicated to you upon collection.
5. Disclosure of your information
We will not sell your Personal Information. We may share information with subsidiaries, affiliates, contractors, and service providers who support our Services (such as IT and hosting providers); as part of a merger, acquisition, or reorganization (with notice to you); in response to legal processes or government requests; with payment processors and financial institutions to process payments; and as appropriate to protect Traduality, other users, and third parties. Mobile Information is never shared with third parties for their own marketing purposes.
6. De-identified information
We may create aggregated and/or de-identified data sets based on the information we obtain from you. This information is no longer capable of identifying you, and we may use it for any purpose we determine appropriate, in accordance with legal restrictions. De-Identified Information is the property of Traduality.
7. Your user content
Information you voluntarily include and transmit in publicly accessible spaces — blogs, social media platforms, public profiles, open forums — may be viewed and used by others without restriction. By using such services, you assume the risk that personally identifiable information you provide publicly may be viewed and used by third parties.
8. Third-party APIs
If you log in to an Account or access our Services using a third-party API, or if we offer an API tool to a third party, information you provide upon login may be shared with the party offering or using the API. Read such third party's policies before submitting any information.
9. Children
The Website and Services are intended for users over the age of 16. We do not knowingly collect Personal Information from individuals under 16. If you become aware that an individual under 16 has provided us with Personal Information, please contact us.
10. Territory
Traduality is located in the United States, and our servers are maintained in the United States. If you access the Website or use Services from outside the United States, you do so at your own risk, are responsible for compliance with the laws of your jurisdiction, and give us express permission to transfer such data to our servers in the United States.
11. Your choices regarding your data
Your Account may provide options with respect to information we collect, including options to update or delete certain information. If you delete certain information or decline to share it, we may not be able to provide some features and functionalities of the Website.
12. Communications with us
By using certain Services, you consent to receive in-product communications and push notifications. You may receive other communications from us when necessary, including by text or phone call. Message and data rates may apply. You may opt out of certain communications through your Account or by reaching out to us.
13. Account closure & deletion
We retain your information for the entire time your Account is open. After you close your Account, we may retain information as long as necessary to comply with legal requirements or protect our legal interests; on backup and disaster recovery systems per our policies; and indefinitely for information that has been de-identified or aggregated. For institutions with a services agreement: retention and deletion of confidential information processed through the platform are governed by that agreement, including deletion of member voice recordings within 180 days of submission, content submitted to Fire Lingo Cloud within one year, all confidential information within 60 days of termination, and any confidential information within 14 days of a written request.
14. Security of information
We have put in place industry-standard procedures to safeguard and help prevent unauthorized access and maintain data security. We cannot guarantee that 100% of data transmissions are secure, and you acknowledge the inherent limitations of Internet security. For payments, we may use a third-party payment processor with its own terms and policies.
15. Consent revocation and opt-out
To the extent we rely on your consent to process information, you may revoke that consent at any time by unsubscribing, opting out through your Account, or contacting legal@traduality.com. To opt out of mobile communications, see the Mobile (SMS/MMS) Program Privacy section.
16. Third-party services
This document only addresses information you provide to us. Other sites accessible through our Website have their own privacy policies and practices. We are not responsible for the policies or practices of third parties.
17. Mobile (SMS/MMS) program privacy
If you opt in to our Mobile Program, we collect Mobile Information such as your mobile number, opt-in/opt-out status, time stamps, and message content. We do not sell Mobile Information or share it for third-party marketing. We share it only with vendors that help us operate the program. Reply STOP to opt out at any time; reply HELP for help. Message and data rates may apply.
18. Your rights under US state laws
Depending on your state of residence, you may have the right to know what Personal Information we collect and access it; request correction of inaccurate information; request deletion; obtain a portable copy; and opt out of processing for targeted advertising and profiling. To exercise these rights, contact legal@traduality.com. We may require identity verification, will respond within 45 days (or notify you of an extension), and will not discriminate against you for exercising your rights.
